NOTICE: THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Who We Are
VitalWay Health, Inc. is a covered entity and/or business associate under HIPAA. This Notice applies to all health information we create, receive, or maintain about you in connection with the healthcare services we facilitate.
Our Obligations
We are required by law to:
- Maintain the privacy of your Protected Health Information (PHI)
- Provide you with this Notice of our legal duties and privacy practices
- Follow the terms of the Notice currently in effect
- Notify you in the event of a breach of your unsecured PHI
How We May Use and Disclose Your Health Information
Treatment: We may use and share your health information to provide, coordinate, or manage your care. For example, we may share your intake information with the licensed provider reviewing your case.
Payment: We may use and share your health information for payment purposes, such as billing your subscription or coordinating with your pharmacy for prescription fulfillment.
Healthcare Operations: We may use and share your health information for our internal operations, including quality assessment, provider credentialing, and compliance reviews.
As Required by Law: We will disclose your health information when required by federal, state, or local law.
Health Oversight: We may disclose your health information to government agencies authorized to oversee the healthcare system.
Public Health Activities: We may disclose your information for authorized public health purposes, such as reporting certain communicable diseases.
Uses and Disclosures Requiring Your Authorization
We will obtain your written authorization before using or disclosing your PHI for purposes other than treatment, payment, and healthcare operations, including:
- Most uses of psychotherapy notes
- Uses of PHI for marketing purposes
- Sale of PHI
Your Rights
Right to Access: You have the right to inspect and copy your health information maintained by VitalWay.
Right to Amend: You have the right to request that we amend your health information if you believe it is incorrect or incomplete.
Right to an Accounting: You have the right to receive an accounting of disclosures of your PHI for purposes other than treatment, payment, and healthcare operations.
Right to Restrict: You have the right to request restrictions on how we use or disclose your health information, though we are not always required to agree to your request.
Right to Confidential Communications: You have the right to receive communications from us by alternative means or at alternative locations.
Right to a Paper Copy: You have the right to receive a paper copy of this Notice upon request, even if you have agreed to receive it electronically.
How to Exercise Your Rights

Complaints
If you believe your privacy rights have been violated, you may file a complaint with VitalWay or with the Secretary of Health and Human Services. We will not retaliate against you for filing a complaint.
Changes to This Notice
We reserve the right to change this Notice. Changes will apply to health information we already hold about you, as well as new information received after the change. The effective date on this Notice will be updated whenever we make a material change.
